(the wall is 12' at the highest point) It was built during the construction of the house which is under permit but it is not connected to the house, nor does it support any part of the house. It is under the driveway and parking pad. We don't require permits for accessory structures.

However, that would not address prohibitions made on a federal or state level due to environmental regulations (i.e. CWA, CAA, etc.).

BOCA codes had general construction provisions for basements addressing concrete, rebar, wall lengths, wall heights, and floor framing strength with connections specified. If retaining; then engineering generally would be required.
